Introduction
These Terms and Conditions (“Terms”) govern the provision of cleaning services by CCS Group (“we,” “us,” or “our”) to you, the customer (“you” or “your”). By engaging our services, you agree to comply with and be bound by the following Terms. These Terms apply to all cleaning services provided by CCS Group, including but not limited to commercial cleaning, residential cleaning, carpet cleaning, post-construction cleaning, and eco-friendly cleaning solutions.
These Terms are governed by New Zealand law, including the Fair Trading Act 1986 and the Consumer Guarantees Act 1993.
- Definitions
- “Services” refers to the cleaning services provided by CCS Group as outlined in the service agreement or quotation.
- “Premises” refers to the residential or commercial property where the cleaning services will be provided.
- “Customer” refers to any individual or business entity entering into an agreement with CCS Group for cleaning services.
- “Service Agreement” refers to the specific terms agreed upon between CCS Group and the customer regarding the scope, frequency, and cost of the cleaning services.
- Scope of Services
CCS Group provides the following services:
- Commercial cleaning (regular or one-off services)
- Residential cleaning (regular or one-off services)
- Carpet cleaning and shampooing
- Post-construction or post-builders cleaning
- Hard floor strip and seal cleaning
- Eco-friendly cleaning solutions
The specific services to be provided will be detailed in a service agreement, proposal, or quotation accepted by the customer. CCS Group reserves the right to refuse any service request that falls outside the agreed-upon scope.
- Service Area and Availability
We provide services within Christchurch and Dunedin, New Zealand. Service availability is subject to our resources, schedule, and geographical location of the customer. We reserve the right to decline a service request based on location or other operational constraints.
- Service Agreements
All customers will be provided with a service agreement or quotation outlining the services to be provided, the cost, and the frequency of the services. The service agreement will be considered accepted once the customer provides written or verbal confirmation, or payment is made for the services.
- Service Fees and Payment Terms
- Quotation: All quotations for services are valid for 30 days unless otherwise specified. Prices are exclusive of GST unless explicitly stated.
- Payment Terms: Payment is due upon receipt of the invoice, unless alternative arrangements have been made in writing. Commercial clients may have specific terms agreed upon in their service contracts.
- Late Payments: If payment is not made by the due date, CCS Group reserves the right to charge interest on overdue amounts at a rate of 1.5% per month. We may also suspend services until the outstanding balance is paid.
- Payment Methods: We accept payments via bank transfer, credit/debit card, or any other method specified in the invoice.
- Cancellations and Rescheduling
- Residential Services: You may cancel or reschedule a cleaning service without penalty by providing at least 24 hours’ notice. Cancellations made with less than 24 hours’ notice may incur a cancellation fee of up to 50% of the service charge.
- Commercial Services: Cancellation and rescheduling terms for commercial clients will be specified in the individual service agreement. Cancellations or rescheduling must generally be made at least 48 hours before the scheduled service. Failure to provide adequate notice may result in the customer being charged for the full service.
- Customer Responsibilities
Customers are responsible for:
- Providing access to the premises on the scheduled cleaning day. If we are unable to access the premises, the customer will be charged for the full service.
- Removing any items that may obstruct the cleaning process, such as personal belongings or furniture.
- Ensuring that any hazardous materials or areas are identified and communicated to CCS Group before the cleaning service begins.
- Ensuring that pets or other animals are secured and do not interfere with the cleaning staff.
Failure to comply with these responsibilities may result in delays, additional charges, or refusal to provide services.
- Health and Safety
CCS Group adheres to all relevant health and safety regulations as per New Zealand law. Our staff is trained to identify and manage potential hazards during cleaning services. Customers must inform us of any health or safety risks at the premises, such as hazardous chemicals, broken fixtures, or unsafe flooring.
- Service Guarantee and Rework
CCS Group is committed to delivering high-quality cleaning services. If you are dissatisfied with any aspect of our work, please notify us within 48 hours of the service. We will take reasonable steps to resolve the issue, which may include redoing the unsatisfactory work at no additional cost.
- Limitations of Liability
While we strive to provide the best possible service, CCS Group is not liable for:
- Pre-existing damage to the customer’s property, including worn carpets, damaged flooring, or faulty fixtures.
- Loss or damage to valuable items (e.g., electronics, jewelry) unless specifically listed and agreed upon before service.
- Indirect, consequential, or incidental damages arising from our services, including loss of business or income.
- Any damage resulting from incorrect instructions provided by the customer.
- Damage caused by third parties during or after the cleaning services.
CCS Group’s liability is limited to the total cost of the service provided.
- Warranties and Consumer Guarantees
Under the Consumer Guarantees Act 1993, you are entitled to certain guarantees concerning the quality and timeliness of the services provided. These guarantees include that the service will be delivered with reasonable care and skill, and that it will be fit for its intended purpose. If CCS Group fails to meet these guarantees, you have the right to request a remedy, which may include rework or a refund for services not performed as agreed.
- Intellectual Property
All content provided by CCS Group, including but not limited to marketing materials, website content, and service agreements, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content without prior written consent from CCS Group.
- Privacy and Confidentiality
CCS Group collects and uses personal information in accordance with our Privacy Policy, which complies with New Zealand’s Privacy Act 2020. We are committed to protecting the privacy and confidentiality of our customers’ personal and business information. Please refer to our Privacy Policy for more details on how we handle personal data.
- Dispute Resolution
In the event of a dispute regarding these Terms or the services provided, both parties agree to attempt to resolve the issue in good faith through informal negotiations. If the dispute cannot be resolved, the matter may be referred to mediation or the New Zealand Disputes Tribunal.
- Force Majeure
CCS Group will not be held liable for any delay or failure to provide services due to events beyond our control, including but not limited to natural disasters, government restrictions, labor strikes, or pandemics. If such events occur, we will communicate with you to reschedule the services as soon as reasonably possible.
- Changes to Terms and Services
CCS Group reserves the right to amend these Terms at any time. Any changes will be communicated to customers via email or updated on our website. Continued use of our services following any such changes will constitute acceptance of the revised Terms.
- Governing Law
These Terms and Conditions are governed by the laws of New Zealand. Any legal proceedings arising out of or relating to these Terms will be brought before the courts of New Zealand.
